All three branches of government established by the Constitution have an impact on patent law. As the legislative branch, Congress passes the laws that govern the patent system. The USPTO, as part of the executive branch, implements the patent laws passed by Congress. The federal courts of the judicial branch review the laws passed by Congress and the regulations promulgated by the USPTO to implement the laws, and can also resolve disputes between parties.
宪法设立的政府三大部门均对专利法产生影响：作为立法部门，国会制定规范专利制度的法律；作为行政部门的一部分，美国专利商标局（USPTO）执行国会通过的专利法；司法部门的联邦法院负责审查国会通过的法律及美国专利商标局（USPTO）为执行法律而制定的法规，并可解决当事人之间的纠纷。

1.three branches of government。Government在这里并非单纯指的是“政府”，而是宪法意义上的国家政权体系。大家都知道，美国是一个三权分立的国家，包括：立法分支（legislative branch）、行政分支（executive branch）和司法分支（judicial branch）。
我们中国人平时口语里说的政府，基本上就等于行政机关，不包括法院、检察院等司法机关，也不包括人大、人大常委会等立法机关。
所以这里的government应当作广义的理解，不能仅理解为政府。
2. the laws that govern the patent system。govern在这里并不是“统治、管理”意思。例如，The country is governed by elected representatives of the people.这个国家由民选代表统治。统治的主体是人或者机构，这里的主语是法律，是人制定出来的。法律本身并不是人，不能讲话，没有自身的主观思想，所以不能主观地去统治别人。
Govern在这里的意思是“规范、规制、对…有约束力”的意思。我们在学习英语时，可以先从英语转换为汉语，然后再从汉语转回英语，看看自己从汉语转回英语时，还能不能用到原词？就例如这里的govern，当我们从汉语的“规范”再翻译为英文时，能不能想到把这里的“规范”翻译为“govern”？长此以往，我们的词语选择水平必然会水涨船高，用词也会比较地道。
有一些学习者比较鄙视这种学习方法，认为在大脑中进行英汉互译不利于建立其英语思维。这种思想在一定范围内是有道理的，但是这种思想是有前提的。前提就是学习者必须经过大量的英文原文阅读，或者每天浸泡在英文语境中。在国内，这种情况基本实现不了，除非是学生，因为他们有大量的自由时间。在职者若没有从事英文工作，则根本没有那么多时间去系统化阅读英文原文。即便去英语角，英语角里也大多都是中国人，英文水平参差不齐，谁知道别人说的就是地道的呢？万一又被别人误导了呢？所以凡事不如靠自己。
另外，这些学习者所认为的英语思维也只限于日常交际口语，经过长期的训练，的确可以不经过大脑内部翻译而脱口而出。但是我们专利上所用的是法律术语，是比较专业的。每一个英文单词都有着其内在的含义，这是该单词的中文翻译所无法表达出来的，我们学习的目的就在于理解每一个英文单词的隐含含义，而不是把中文单词与英文单词划等号。即便欧美的律师，在写法律文件时，也是要仔细推敲的，即便自己已经很专业了，但是他们在撰写不同的法律文件时，也不是仅凭经验就随便用词的，是要不断查询法律词典，在某个地方用这个单词，而不用那个单词，需要经过深思熟虑的，根本就不像这些学习者说的那样不用分辨单词之间的区别及所用的语境。
我们目前学的资料是USPTO的权威资料，语言必然是地道的，剩下来的工作就是好好地研读、仔细地推敲人家的用词、造句。慢慢地沉下心来去研究，学习，就会进步很快。这份资料还是比较简单的，内容也少，后面我们可能再学习其它的较难的英语资料。我们目前先打好坚实的基础，后面再学其它资料就很快了。
还有想说的是，有人认为AI时代到来了，AI翻译能力很强，译者就要下岗了，也不用再学习英语了。笔者个人认为，AI翻译能力是很强，但是短时间内还取代不了人脑。你给AI一段中文语料，AI是按照字面意思进行翻译的，但是语言总是有局限性的，AI目前还不可能理解这个中文语料的背景以及隐含意义，从而不可能做到100%按照原义进行翻译，这方面人是可以做到的。所以不用担心短期内被取代。万一被取代，大家沉下心来的认真学习态度，也会支持自己去转向更好的行业。
Federal statutes and judicial precedents together govern the determination of patent eligibility, inventiveness, and claim scope.联邦成文法与司法判例共同规范专利适格性、创造性以及权利要求保护范围的认定。
The terms and conditions of a patent license agreement shall be governed by the laws of the state in which the agreement was executed.专利许可协议的条款与内容，应受协议签署地所在州的法律管辖。
The procedures for ex parte reexamination and inter partes review are governed by detailed rules promulgated by the USPTO.单方复审与双方复审的程序，受美国专利商标局颁布的详细规章所规范。
3. implements the patent laws的implement及其类似词：
(3.1) implement的意思是“实施、执行、贯彻、落实”等，强调从设计出来到实际落地这个过程，正文例句含义是：当法律被立法机关制定出来并生效后，执法机关真正去做、去运行、去落地这个法律。
The USPTO is responsible for implementing the patent statutes enacted by Congress.美国专利商标局负责执行国会颁布的专利法。这里强调的是法律从颁布到落地实施。
The guidelines implement the statutory requirements for patentable subject matter.该审查指南落实了关于专利保护客体的法定要求。
The system is configured to implement a novel encryption algorithm that enhances data security during transmission.该系统用于（很多人常翻译为“被配置为”）实现一种新型加密算法，以增强数据传输过程中的安全性。这里强调的是算法从设计出来到落地实施。
To implement the method, a plurality of sensors are disposed on the surface of the device to collect real-time data.为实施该方法，多个传感器被布置在设备表面以收集实时数据。这里强调的是方法的落地实施。
(3.2)execute的意思是“执行、履行具体的操作”，多强调按照既定的流程完成，宾语多用于计算机程序、合同、实验步骤等。
The processor is programmed to execute a series of instructions to control the robotic arm’s movement.处理器被编程以执行一系列指令，控制机械臂的运动。
Upon receiving a user command, the device executes a predetermined sequence of operations to achieve the desired output.接收到用户命令后，设备执行预定的操作序列以实现预期输出。
The parties shall execute the patent assignment agreement before recording the transfer of patent ownership with the administrative authority.各方应在向行政机关登记专利所有权转让之前，签署并履行专利转让协议。
(3.3)enforce的意思是“依靠权力来强制执行”。
The patent owner may ask the court to enforce an injunction to stop others from making, using, or selling the infringing products.专利权人可请求法院强制执行禁令，禁止他人制造、使用、销售侵权产品。
The digital rights management system enforces usage restrictions by encrypting content and validating user licenses.数字版权管理系统通过加密内容和验证用户许可证来强制执行使用限制。
The patent claim describes a mechanism to enforce compliance with safety protocols in industrial machinery.专利权利要求描述了一种在工业机械中强制遵守安全协议的机制。
(3.4) carry out的意思是“执行、完成某个动作、任务等”，侧重于动作是否能够完成性，较为口语化。
The skilled person may carry out the method described in the specification.本领域技术人员可实施说明书中所述方法。
The experiment was carried out under controlled conditions to verify the efficacy of the compound.实验在受控条件下进行，以验证化合物的有效性。
4. The federal courts of the judicial branch实际上应该是The federal courts (as part) of the judicial branch，因为前面已经出现了as part，所以这里省略了。
5. promulgate及其类似词
(5.1) pass。正文例句中用的表达是pass the patent laws，promulgate the regulations。
Pass的意思是“通过（法案）”，强调立法机关（正文例句指的是Congress）投票通过了该法律。只有立法机关才能通过法律，那么pass的主语需要是立法机关，我们国家就是人大，西方国家就是国会或议会等。
The National People's Congress passed the fourth amendment to the Chinese Patent Law, significantly increasing statutory damages for willful infringement. 全国人民代表大会通过了《专利法》第四次修正案，大幅提高了对故意侵权的法定赔偿额。
The legislature passed the bill to amend patent infringement provisions.立法机构通过了修改专利侵权条款的法案。
(5.2) Promulgate。强调正式发布（法规或规章等），让公众知晓其生效。在我国，法规或规章的颁布者一般是行政机关，而不是立法机关。正文例句中的USPTO也属于行政机关。
The State Council promulgated the revised Implementing Regulations of the Patent Law, which provide detailed rules for the application of the new patent linkage system.国务院颁布了新修订的《专利法实施细则》，为新的专利链接制度提供了具体操作规则。
The USPTO promulgated new rules for patent eligibility.美国专利商标局颁布了新的专利适格性规则。
(5.3) enact制定和颁布，包含了使草案成为法律的全过程，强调的是赋予其法律效力，比“promulgate”更侧重整个立法行为。
Many countries have enacted patent laws that comply with the minimum standards set by the TRIPS Agreement.许多国家都已制定了符合《TRIPS协定》最低标准的专利法。
The statute enacted in 2011 revised the definition of prior art.2011 年颁布的该成文法修改了现有技术的定义。
(5.4) issue 指的是：权威机构正式发出了具体的文件，例如专利证书、具体的规定等。
The China National Intellectual Property Administration (CNIPA) issued the latest version of the Patent Examination Guidelines to clarify the criteria for assessing inventiveness in emerging technologies.中国国家知识产权局发布了最新版《专利审查指南》，以明确新兴技术创造性的审查标准。
The USPTO issues a patent to the inventor after approval.美国专利商标局在批准后向发明人颁发专利。
(5.5) enter into force、或come into force，或take effect，侧重于某个文件在颁布之后生效。例如专利法，其颁布日就是对公众开放之日，公众就能够得知专利法的具体条款，但是颁布时专利法还没有生效，其中规定了某一天会生效，过了这一天，专利法才能最终生效，并产生普遍约束力。但是有些法律，在颁布之日就会生效。
The Hague Agreement Concerning the International Registration of Industrial Designs entered into force in China on May 5, 2022, benefiting applicants seeking multi-jurisdictional design protection.《工业品外观设计国际注册海牙协定》于2022年5月5日在中国生效，为寻求多辖区外观设计保护的申请人带来了便利。
If not specified otherwise, these rules enter into force upon their publication.除另有规定外，本规则自公布之日起生效。
总之，一部专利相关法律草案通常先被立法机关通过（passed），随后被官方颁布（promulgated），以使公众知道，最后在指定日期后生效（enters into force）。而Enact 可用于概括描述这一个完整过程。
6. resolve及其类似词
(6.1) resolve 强调解决的是纠纷、争议、冲突、矛盾等。这些是由多方引起的。仅单方是不可能存在纠纷、冲突的。自己跟自己也没办法打架吧，除非能习得周伯通的左右互搏术。
The court resolves disputes over patent infringement.法院解决专利侵权纠纷。专利侵权纠纷肯定是涉及双方的，不可能自己（单方）侵犯了自己的专利权。
If a dispute arises regarding the interpretation of this license, the parties shall first seek to resolve the dispute through good-faith negotiations.”如果就本许可的解释产生争议，双方应首先寻求通过善意谈判解决争议。许可是需要签署许可合同的，这也涉及双方或多方。
(6.2) solve 前面我们也说过，solve强调的是从结果上考虑，彻底解决了这个问题。这个是单方导致的问题，而一般不是双方或多方导致的纷争。
The invention solves the technical problem of low efficiency.本发明解决了效率低的技术问题。这个是技术问题肯定是这个设备或方法单独导致的，不可能是两个设备相互打架造成的吧？
(6.3)settle强调纠纷已经了解了，双方已经达成一致意见，即和解了。比如，settle out of court就是诉讼双方达成了庭外和解。
The parties settled the patent dispute through a licensing agreement.双方通过许可协议和解了专利纠纷。
The company agreed to settle the patent infringement lawsuit by paying a lump-sum royalty and entering into a cross-license agreement.该公司同意通过支付一笔一次性许可费并达成交叉许可协议，来和解专利侵权诉讼。
(6.4) address这里再复习一下，address只表示着手处理问题，不强调是否解决完毕这个问题。
The new law addresses the problem of patent trolls.新法律应对了专利流氓的问题。
(6.5)reconcile消除双方矛盾，使之达成一致。
The mediator helped the parties reconcile their opposing positions on the scope of the licensed field of use.调解员帮助双方调和了他们在许可使用领域范围上的对立立场。该词强调使对立的立场趋于一致。
Reconcile常常与with一起联用。例如，reconcile A with B使 A 与 B 保持一致
The court attempted to reconcile the new statute with existing judicial precedents.法院试图使新成文法与现有司法判例保持一致。
It is difficult to reconcile the broad interpretation of claim terms with the specification disclosure.难以将权利要求用语的宽泛解释与说明书公开内容协调一致。
大致可以按照如下理解各词之间的关系：
我们正在处理（address）一项双方的纠纷，但是目前可能还没结果。双方此时纠纷有升级，演变成了一场官司。我们调和（reconcile）了双方的分歧，使他们的立场达成了一致。双方不再打官司了，那我们就了结（settle）了这场官司。最终，我们帮争议双方成功解决（resolve）了他们之间的纠纷。
