解释和拓展：
1.Note在这里并不表示“做笔记”、“记录”的意思，而是“请注意、请关注”的意思。本身是祈使语气，是一种引导词，用来提醒读者重点关注其后面的内容（后面的内容是重点）。在涉外专利代理的往来信件中，外国代理人要提醒阅读者注意期限、费用等，那么前面就加上Please note that…。
Please note the difference between a product claim and a process claim.请注意产品权利要求与方法权利要求之间的区别。
(1.1)Notic则是“注意到”的意思，描述的是在视觉上有没有看到。并不用于提示重点。
You may notice that the claim uses multiple transitional phrases.你可能会注意到该权利要求使用了多个过渡用语。该句只是描述有没有看到这些过渡用语，但是过渡用语并非某个权利要求的重点，technical features才是其重点。
The examiner should notice any inconsistent terminology in the specification.审查员应注意到说明书中任何不一致的术语。
(1.2)Pay attention to偏重于口语使用，往来邮件、书面语等较少用。
Please pay attention to the antecedent basis of each claim term.请留意每个权利要求术语的引用基础。
(1.3)Be reminded that在涉外专利代理中，有些外国代理人还用到这个短语，表示特此提醒，请务必记住和遵守之意，带有提醒、告诫的语气。
Be reminded that prior art includes all publicly available information before the filing date.请务必记住，现有技术包括申请日之前所有公开可获得的信息。
Be reminded that the patent term begins on the date of grant.请务必注意，专利期限自授权之日起算。
2.employ及其表示“用”的类似词：
（2.1）employ在这里是“（有目的地）使用、运用”的含义，而不是“雇佣”。
The applicant employed means plus function language in the claims.申请人在权利要求中使用了手段 + 功能语言。
The drafter employed a Markush group to cover multiple alternatives.撰写者采用了马库什群组以涵盖多种替代方案。
The examiner employed the broadest reasonable interpretation standard.审查员适用了最宽合理解释标准。
（2.2）use最普通的使用，不像employ是带有目的的使用，带不带有目的而使用都可以用use。
The claim uses a transition phrase “comprising”.权利要求使用了过渡术语“包括”。主语为the claim，其并非人，并不带有目的。
（2.3）utilize加以利用、有效利用，强调使其发挥效用，以达到“物尽其用”。
The prior art utilizes the same material to solve the problem.现有技术利用相同材料解决该问题。
The system utilizes a feedback loop to improve accuracy.该系统利用反馈回路提高精度。
（2.4）adopt采用，采纳，有从“多个选项中，选择其一”的含义。
The Patent Office adopted a new guidance for patent eligibility.专利局采纳了新的专利适格性指南。
The applicant adopted a narrower definition in the amendment.申请人在修改中采用了更窄的定义。
（2.5）apply应用、适用于某个特定的对象或特定的场景中。
The examiner applied the broadest reasonable interpretation.审查员适用了最宽合理解释标准。
This rule applies to all pending applications.本规则适用于所有未决申请。
（2.6）exploit指商业化利用，实施，常用于表示“实施专利”，所谓实施专利，一般指的是将专利技术从纸面上转为落地的技术，既然该技术能够落地，那么必然是有价值的，能够带来一定程度的商业化价值。
The patent owner has the right to exclude others from exploiting the invention.专利权人有权排除他人实施该发明。
The licensee is authorized to exploit the patent in the territory.被许可方被授权在该地域内实施该专利。
（2.7）avail oneself of书面用语，可以表示利用法律上的权利等。
The applicant may avail himself of the right of priority within the time limit.申请人可在期限内行使优先权。
Any dissatisfied party may avail itself of the appeal procedure.任何不服的当事人均可利用申诉程序。
（2.8）take advantage of利用机会、情况
The practitioner took advantage of the interview to clarify arguments.代理人利用会晤机会阐明意见。
The applicant took advantage of the priority claim to secure an earlier date.申请人利用优先权要求以获得更早申请日。
3. drafter指的是起草人，撰写者。例如：the drafter of the patent application专利申请的起草人、the drafter of the claims权利要求撰写人、the drafter of the statute法令起草者。
drafter撰写出来的是草稿，而非正式文稿，所以不用author，也不用writer。为什么此处强调起草人呢？是因为法律文件一开始是需要有人来写成文字的，负责把法律写成文字，写出各种条款的人，就叫drafter。此时写好的文本叫法律草案，例如a draft constitution就是宪法草案。这个草案不会立刻生效，还要经过一系列的法定程序，比如这个机构审核，那个机构征询意见，还有其他的特定机构批准、公布等，才能生效，最终才会形成一个有法律约束力的文件，成为具有普遍适用性的法律。但是既然法律草案是由起草者编写的，那么该法律草案在定稿的那一刻，就带有起草者自己的思想，剩下的就是小修小改，不会出现大的增删。
在正文例句中，宪法中采用了平行结构，往前推就是宪法草案也采用了平行结构，那么最早就是起草者（the drafter）采用了平行结构，故这里写的是drafter，而不是立法者。
立法者是legislator或者lawmaker，是决定要不要立法，或者投票通过法律的人，其是个裱糊匠，对法律草案评头论足，增增删删改改，并不具体负责the drafter在起草时以什么样的逻辑来撰写法律草案。
(3.1)legislator立法者，指的是拥有立法权的人，这个权利是宪法或法律授予的，侧重于对该人身份、职位的描述，在欧美常常指代议员。
The legislator introduced a new bill on patent reform.这位立法者提出了一项专利改革新法案。Bill就是指的法案的意思，而不是钱。
The legislator who proposed the amendment to the patent statute sought to strike a balance between protecting the exclusive rights of inventors and promoting the public access to useful technologies.提出专利法修正案的立法者，力求在保护发明人独占权与促进公众对实用技术的获取之间达成平衡。
It can be inferred from the legislative history that the legislators intended to extend the patent term for pharmaceutical inventions to compensate for regulatory delays during the approval process.从立法历史可以推断，立法者旨在延长药品发明的专利期限，以补偿审批过程中的监管延迟。
(3.2)lawmaker制定法律的人，常常用于口语，新闻媒体用语，用作统称某一类人。如果特指某一个人或某一类人是立法者，那么就要用legislator或legislators，以显示出其有立法的权威。而lawmaker强调的是能够制定法律，不一定会单独强调其具有立法的权威。
Lawmakers debated the scope of copyright protection.立法者就版权保护范围进行了辩论。这句话就是泛指一大群立法者，不局限于某个人。我们刚才提过，立法是要走繁琐的立法程序的，每一道程序都有一大批人参与，那么这些人都会参与讨论，但是每个人所起的作用和重要性又会有不同，统一起见，统称为Lawmakers，所以基本上采用复数形式。
Many lawmakers have expressed concern that overly broad patent claims may hinder innovation in the software industry and lead to an increase in costly litigation.许多立法者担忧，过于宽泛的权利要求可能阻碍软件行业创新，并导致高成本诉讼增多。
In recent hearings, lawmakers have debated whether the current patent system adequately protects small inventors and startups against large institutional patent holders.在近期听证会上，立法者就现行专利制度是否充分保护小型发明人和初创企业免受大型机构专利权人的影响展开了辩论。
从上面例句可以看出，legislator往往后面直接就是跟着法律中的权利与义务，例如法案、独占权、药品发明的专利期限延长等等，而lawmaker一般不跟着法律中的权利与义务，例如，保护范围、权利要求、专利制度，故lawmaker往往不直接对应权利与义务。
4. refer to的词义很多，以下分别介绍：
(4.1)“指的是”，该含义常用于法律解释，即解释某一个名词或法律概念的法律含义。
The term “useful arts” as used in the Constitution refers to practical technologies and inventions.宪法中使用的“实用技艺”一词指的是实用技术和发明。
The phrase “exclusive right” in this provision refers to the monopoly rights granted by a patent.本条款中的“独占权”指的是专利授予的垄断权。
“Prior art” generally refers to all public knowledge before the filing date.“现有技术”通常指的是申请日之前的所有公知常识。
(4.2)“提到，提及”，常用于在论述中使用，因为“提到”的动作发出者往往是人，所以主语通常是人。而(4.1)的句子主语往往是一个概念。
The applicant referred to three prior art patents in the specification.申请人在说明书中提及了三件现有技术专利。
The court opinion referred to the legislative history of the Patent Act.法院判决意见提及专利法的立法历史。
(4.3)“查阅、参考”；
The examiner may refer to the official guidance before issuing a rejection.审查员在发出驳回决定前可查阅官方指南。
You should refer to the claim when interpreting the technical terms.解释技术术语时应参考权利要求。
(4.4)refer A to B，意思是：把A提交给B，以供B处理或裁决；
The board referred the case to the administrative judge for a hearing.委员会将该案交由行政法官进行听证。
We refer this dispute to arbitration under the patent license agreement.我们根据专利许可协议将此争议提交仲裁。
当然也可以用被动形式，但是此时要双写r。
The matter was referred to a senior examiner for review.该事项被转交给资深审查员进行复核。
The case was referred to the Patent Trial and Appeal Board.该案被提交至专利审判和上诉委员会。
(4.5)A is referred to as B，意思是：被称为、被叫做，类似于be called，be known as，但是在学术文本中常用A is referred to as B，而不常用be called，be known as。
This type of claim is referred to as a means-plus-function claim.这种权利要求被称为手段+功能权利要求。
The principle is referred to as the doctrine of equivalents.该原则被称为等同原则。
Be called常作为非正式用语。例如，The right to exclude others is called the exclusive right of a patent.排除他人的权利被称为专利的独占权。
Be known as强调是大家公认的。例如，He is known as a pioneer in patent law.他被公认为专利法的先驱。
因为Be called是非正式用语，Be known as强调是大家公认的，带有主观含义，而文献往往要遵循严谨性和客观性，所以这两个词不常用于文献中。
5. Useful arts中arts的含义。Arts在这里不是“艺术”的意思，而是“实用技艺、实用技术”的意思。专利本身属于技术方案，那么就是技术范畴，所以这里的arts也是技术范畴，故Useful arts可以近似理解为practical technologies，但是不要用practical technologies来表达，这是专业术语，也就是行话。
一般而言，我们从事哪一行，就要说哪一行的行话，不然就不被认为是行内人，会被当作不专业的门外汉。例如，prior art意思是“现有技术”，也可以说是“在先技术”，有时候甚至简化为art。state of the art 指的是“现有技术水平”，不要一看到水平，就翻译为level，咱们专业人士还是尽量说行话。这两个词的不同之处在于：State of the art多指申请日之前公众可获知的所有技术信息的整体状态，是判断发明是否具有新颖性和创造性的基准。而Prior art常指“state of the art”中与当前发明相关的具体技术文献（如专利、论文、产品等），用于直接对比。
This step is well known in the art.该步骤在本技术领域中众所周知。这里直接简化为art也没问题。
The invention is not obvious over the prior art.该发明相对于现有技术不具备显而易见性。这里的“相对于”不要用be compared to，或be compared with，直接用over就行了。
The applicant cited three pieces of prior art in the information disclosure statement.申请人在信息披露声明中引用了三件现有技术。
The device represents the state of the art in sensor technology.该装置代表了传感器技术的现有技术水平。
The method is superior to the state of the art in terms of efficiency.该方法在效率方面优于现有技术水平。
如果不是在专利语境中，并且state of the art用作形容词，则往往可以解释为“最先进水平的”。假设比prior art更先进的专利技术并没有公开，那么the state of the art就是最先进水平了。词典中对state of the art用作形容词时的解释为：using the most modern or advanced techniques or methods; as good as it can be at the present time，这里用的是最高级，那么也就指的是最先进水平。为了区分起见，作形容词时常常加上连词符。
The apparatus employs a state-of-the-art control system.该装置采用最先进的控制系统。
The prior art discloses a state-of-the-art cooling mechanism.现有技术公开了一种代表当前技术水平的冷却机构。
专利中的“本领域普通技术人员”有多种翻译，笔者见过的就有如下几种：
（5.1）A person having ordinary skill in the art；skill 在这里是不可数名词，表示技术水平、技能水平，ordinary skill表示一般或普通的技能水平，所以不要用skills。
The first section provides a comparison of inventive step assessment frameworks, including the “person having ordinary skill in the art” standard and the non-obviousness approach.第一节对创造性标准进行了比较，包括“本领域技术人员”概念、非显而易见性判断方法。
（5.2）A person skilled in the art，这里就直接用in the art就行了，不要用in the prior art。
Those skilled in the art could implement various other feature combinations without departing from the scope and spirit of the invention. 本领域技术人员可以实施各种其它特征组合，而不脱离本发明的范围和精神。
（5.3）The skilled artisan；不要用The skilled craftsman，因为这个craftsman一般指的是实体的人，而专利中的本领域技术人员是假想的人。
The skilled artisan will understand that the drawings, described below, are for illustration purposes only. 本领域技术人员明白附图和下述描述只是为了说明的目的。
（5.4）those of skill in the art；
On the contrary, the present teachings encompass various alternatives, modifications and equivalents, as will be appreciated by those of skill in the art. 相反，本发明包括本领域技术人员所能意识到的不同改变、改进和等价物。
（5.5）the skilled person；
In view of paragraph 3 above, the skilled person would regard it a normal design procedure to combine all the features set out in claim 1. 考虑以上的第3段，本领域技术人员认为将权利要求1中陈述的所有特征组合起来只是一种常规的设计过程。
6.art、technique、technique的区别：
(6.1) art在专利中有“技术领域”的意思，是个偏抽象的词汇，多用于第5点的固定搭配，例如prior art, state of the art, in the art。
(6.2) technique表示具体的技术。
The technique for coating is conventional.该涂层技术是常规的。
The application discloses a novel technique for data compression.本申请公开了一种用于数据压缩的新型技术。
(6.3)technology表示宏观的技术，例如整个技术体系。
Recent advances in technology enable this method.近期技术发展使得该方法成为可能。
The invention relates to the field of communication technology.本发明涉及通信技术领域。
